BAT for Ukraine — Improving the framework conditions for the implementation of the European Directive 2010/75/EC on industrial emissions and promoting the use of best available techniques (BAT) in industry.
By signing an Association Agreement with the European Union, Ukraine has agreed to comply with EU climate targets and the Industrial Emissions Directive (IED). A key aspect of achieving these national climate targets will be ensuring that low-emission techniques, best available techniques (BAT), are deployed in the country’s industrial infrastructure. With the support of the project a regulatory framework for transposing the EU Directive into law is being established. Accordingly, the project is also promoting capacity development in companies and state-run facilities, while providing support to the responsible ministries as they develop the legal framework and monitor compliance. In relation to BAT, the project is aiming to facilitate capacity building for domain experts and management in ministries, for environmental regulators and for plant operators, as well as to develop a new IT system to make obtaining permits for large industrial enterprises more efficient and transparent. This, in turn, will enable Ukraine to reduce industrial emissions and greenhouse gas emissions from its industrial sector by the deployment of innovative industrial processes and procedures.
State of implementation/results:
- Official launch of the project: The project was officially launched on 9 July 2019 in Kyiv during a high-level event attended by a delegation from the German Federal Ministry for the Environment, Nature Conservation and Nuclear Safety (BMUV), including Parliamentary State Secretary Rita Schwarzelühr-Sutter and Ukrainian Deputy Environment Minister Mykola Kuzio.
- Ongoing implementation during the time of war: Despite the Russian Federation’s full-scale invasion, the implementation of Best Available Techniques (BAT) in Ukraine continues with strong commitment and in close cooperation between Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH and the Ministry of Environmental Protection and Natural Resources of Ukraine (MEPR).
- Adoption of IED Law: In July 2024, Ukraine passed the national law implementing the IED, establishing a legal foundation for applying BAT standards across industrial sectors.
- Secondary Legislation: Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH supports the development of by-laws and technical regulations. Three key regulations have already been approved by the Cabinet of Ministers of Ukraine.
- Digital Transformation: With the support of the project, a new IT system for issuing integrated environmental permits is being developed. The core platform is complete, and pilot testing with business users is currently underway.
- Financing Mechanisms: A grant-based support scheme was introduced to support Ukrainian companies implement BAT. Modernization projects include reducing air and water emissions, improving waste management, and enhancing energy efficiency in sectors such as food production, metallurgy, and paper manufacturing.
- Capacity Building: Preparations are underway to conduct training sessions for key stakeholders, including government officials and industry representatives, to familiarize them with the new integrated environmental permitting system, including the use of the new IT system.
- Public Dialogue: In February 2025, a national roundtable in Kyiv gathered policymakers, industry leaders, and civil society to discuss progress and next steps toward reforming Ukraine’s industrial pollution prevention system.
