BAT for Ukraine — Improving the framework conditions for the implementation of the European Directive 2010/75/EC on industrial emissions and promoting the use of best available techniques (BAT) in industry.

By sign­ing an Asso­ci­a­tion Agree­ment with the Euro­pean Union, Ukraine has agreed to com­ply with EU cli­mate tar­gets and the Indus­tri­al Emis­sions Direc­tive (IED). A key aspect of achiev­ing these nation­al cli­mate tar­gets will be ensur­ing that low-emis­sion tech­niques, best avail­able tech­niques (BAT), are deployed in the country’s indus­tri­al infra­struc­ture. With the sup­port of the project a reg­u­la­to­ry frame­work for trans­pos­ing the EU Direc­tive into law is being estab­lished. Accord­ing­ly, the project is also pro­mot­ing capac­i­ty devel­op­ment in com­pa­nies and state-run facil­i­ties, while pro­vid­ing sup­port to the respon­si­ble min­istries as they devel­op the legal frame­work and mon­i­tor com­pli­ance. In rela­tion to BAT, the project is aim­ing to facil­i­tate capac­i­ty build­ing for domain experts and man­age­ment in min­istries, for envi­ron­men­tal reg­u­la­tors and for plant oper­a­tors, as well as to devel­op a new IT sys­tem to make obtain­ing per­mits for large indus­tri­al enter­pris­es more effi­cient and trans­par­ent. This, in turn, will enable Ukraine to reduce indus­tri­al emis­sions and green­house gas emis­sions from its indus­tri­al sec­tor by the deploy­ment of inno­v­a­tive indus­tri­al process­es and pro­ce­dures. 

State of implementation/results: 

  • Offi­cial launch of the project: The project was offi­cial­ly launched on 9 July 2019 in Kyiv dur­ing a high-lev­el event attend­ed by a del­e­ga­tion from the Ger­man Fed­er­al Min­istry for the Envi­ron­ment, Nature Con­ser­va­tion and Nuclear Safe­ty (BMUV), includ­ing Par­lia­men­tary State Sec­re­tary Rita Schwarzelühr-Sut­ter and Ukrain­ian Deputy Envi­ron­ment Min­is­ter Myko­la Kuzio. 
  • Ongo­ing imple­men­ta­tion dur­ing the time of war: Despite the Russ­ian Federation’s full-scale inva­sion, the imple­men­ta­tion of Best Avail­able Tech­niques (BAT) in Ukraine con­tin­ues with strong com­mit­ment and in close coop­er­a­tion between Deutsche Gesellschaft für Inter­na­tionale Zusam­me­nar­beit (GIZ) GmbH and the Min­istry of Envi­ron­men­tal Pro­tec­tion and Nat­ur­al Resources of Ukraine (MEPR). 
  • Adop­tion of IED Law: In July 2024, Ukraine passed the nation­al law imple­ment­ing the IED, estab­lish­ing a legal foun­da­tion for apply­ing BAT stan­dards across indus­tri­al sec­tors. 
  • Sec­ondary Leg­is­la­tion: Deutsche Gesellschaft für Inter­na­tionale Zusam­me­nar­beit (GIZ) GmbH sup­ports the devel­op­ment of by-laws and tech­ni­cal reg­u­la­tions. Three key reg­u­la­tions have already been approved by the Cab­i­net of Min­is­ters of Ukraine. 
  • Dig­i­tal Trans­for­ma­tion: With the sup­port of the project, a new IT sys­tem for issu­ing inte­grat­ed envi­ron­men­tal per­mits is being devel­oped. The core plat­form is com­plete, and pilot test­ing with busi­ness users is cur­rent­ly under­way. 
  • Financ­ing Mech­a­nisms: A grant-based sup­port scheme was intro­duced to sup­port Ukrain­ian com­pa­nies imple­ment BAT. Mod­ern­iza­tion projects include reduc­ing air and water emis­sions, improv­ing waste man­age­ment, and enhanc­ing ener­gy effi­cien­cy in sec­tors such as food pro­duc­tion, met­al­lur­gy, and paper man­u­fac­tur­ing. 
  • Capac­i­ty Build­ing: Prepa­ra­tions are under­way to con­duct train­ing ses­sions for key stake­hold­ers, includ­ing gov­ern­ment offi­cials and indus­try rep­re­sen­ta­tives, to famil­iar­ize them with the new inte­grat­ed envi­ron­men­tal per­mit­ting sys­tem, includ­ing the use of the new IT sys­tem. 
  • Pub­lic Dia­logue: In Feb­ru­ary 2025, a nation­al round­table in Kyiv gath­ered pol­i­cy­mak­ers, indus­try lead­ers, and civ­il soci­ety to dis­cuss progress and next steps toward reform­ing Ukraine’s indus­tri­al pol­lu­tion pre­ven­tion sys­tem.
